SHIPPING

IMPORTANT - Defence Export Controls Customer Acknowledgement & Liability Notice
  • The customer is hereby advised and acknowledges that items listed under the Defence and Strategic Goods List (DSGL) are subject to strict export control regulations. These items must not be resold, transferred, diverted, made available to, or otherwise disposed of outside of Australia, or to any foreign national within Australia, without prior written authorization from the Australian Defence Export Control Office (DECO).

  • The customer is further advised and acknowledges that items classified under the U.S. Export Administration Regulations 99 (EAR99) are subject to re-export restrictions as administered by the U.S. Department of State’s Directorate of Defense Trade Controls and the Bureau of Industry and Security (BIS). Such items must not be resold, transferred, diverted, made available to, or otherwise disposed of outside of the United States or Australia, or to any foreign national within either country, without the express written consent of the U.S. Department of State.

  • The customer and/or end-user is hereby notified and acknowledges that they may be required to complete and sign legally binding End-User Certificates (EUCs) and/or Re-Export Declarations to certify compliance with relevant export control legislation, including but not limited to the United States International Traffic in Arms Regulations (ITAR), Export Administration Regulations (EAR), and the European Union Dual-Use Regulation. Refusal or failure to complete these documents may result in order cancellation or withholding of goods until compliance requirements are met.

  • By proceeding with the purchase of Export-Controlled Goods, the customer and/or end-user agrees and acknowledges that Nocturnal Optics Australia, including any of its subsidiaries, branches, or affiliates, accepts no legal liability or responsibility for any breach of Australian or international export control laws resulting from the unauthorized re-export or handling of DSGL, ITAR, EAR99, or EU Export-Controlled items by the customer or end-user.

  • By ordering any product(s) from Nocturnal Optics Australia (the “Site”), you certify that you, or any third-party entities acting at your direction, will not sell, transport, ship, or transfer outside the borders of Australia or any of its states or territories, nor to any foreign person*, any product(s) that are export-restricted by (but not limited to) Australian, European, or U.S. export control laws and regulations without proper export authorization, licensing, and documentation.

Nocturnal Optics Australia, including any of its subsidiaries, branches, or affiliates, will not engage in, support, or facilitate any transaction, whether directly or indirectly, that involves the unlawful export or re-export of prohibited or restricted items.

Defence Export Permits

Mandatory Defence Export Permits for International Orders

  • For international orders of export-controlled items, it is important to understand that these products require an official Defence Export Permit prior to leaving Australia, due to their regulated nature and associated restrictions.

  • The process of obtaining this permit typically takes approximately 10–12 business days for processing and approval.

  • Once the permit has been approved and issued by the Defence Export Controls Office, the items can then be shipped to the customer, generally via Australia Post. Customers should be aware that regulated items cannot be dispatched until the necessary export permit has been granted.

  • This is a legal requirement designed to ensure full compliance with Australian export control regulations.

Defence Export Permit Restocking Fee

  • If a customer chooses to cancel their order and request a refund while the export permit application is still in progress, a restocking fee may apply, unless special circumstances are agreed upon.

  • This fee helps cover the administrative and handling costs associated with processing the order and initiating the export permit application.
Shipping Methods

All items are shipped using insured and tracked services via Australia Post Express or DHL Express, ensuring fast, secure, and reliable delivery.

We require a signature on delivery for all shipments, without exception, to guarantee that your order is received securely and in person.

Our standard method of shipment is Tracked Australia Post Express, providing customers with real-time tracking information and peace of mind throughout the delivery process.

Shipping Security Information

Security Overview

  • Given the sensitive and high-value nature of our Thermal and Night Vision Systems, Nocturnal Optics Australia implements strict security measures to ensure the safe and secure delivery of all products.

Signature on Delivery — Without Exception

  • All shipments require a signature upon delivery, without exception. This policy ensures that the customer personally receives the item and provides an additional layer of verification and accountability, enhancing the overall security of the shipping process.

Tamper-Evident Security Seals

  • To further safeguard the integrity of our products, all packages are sealed with tamper-evident security seals. These seals are designed to clearly indicate if a package has been opened or interfered with during transit. This measure helps protect against unauthorized access and ensures our customers receive their products in the condition they were shipped.

Reporting Suspected Tampering

  • If a customer suspects that their package has been tampered with during transit — excluding any official Government or Customs inspections — they are required to promptly report the incident.

  • Customers should notify the Nocturnal Optics Team as soon as possible by emailing us at admin@nocturnalopticsau.com with all relevant details.
  • We take all such reports very seriously and will conduct a thorough investigation in collaboration with the carrier and, if necessary, relevant authorities to resolve the matter appropriately.
International Import Taxes and Customs Duties

Taxes and Duties Policy

  • Nocturnal Optics does not cover or assume responsibility for any import taxes, customs duties, or related charges incurred upon delivery. These fees are the sole responsibility of the importing party and must be paid in full by the customer.

  • Please note that import taxes and customs duties are not included in the purchase price of our products. We strongly recommend that customers familiarize themselves with their local tax regulations and import requirements prior to placing an order, to avoid any unexpected charges upon delivery.

  • Nocturnal Optics is a Goods and Services Tax (GST) registered Australian business. All sales processed through Nocturnal Optics Australia are subject to 10% GST, which is applied at checkout and reflected in the final purchase price.
Lead Times and Pre-Orders

For pre-orders or items with an advertised lead time, the estimated wait period is clearly stated on the respective product pages. We strongly encourage customers to review and take note of these lead times prior to placing an order.

Items designated as Special Order on our product pages are subject to a standard lead time and are typically shipped 4–6 weeks after the order is placed.

Order Cancellations Or Order Shipping Address Changes

  • Nocturnal Optics maintains a strict policy regarding order cancellations and changes to the shipping address. Customers who wish to cancel an order or report a change to the shipping address must notify Nocturnal Optics within 48 hours of the package being shipped.

  • Adherence to this time frame is critical, as notifications received beyond the 48-hour window significantly reduce our ability to retrieve or redirect the package once it has been dispatched to the original address.

Return Shipping Policy

  • Nocturnal Optics does not cover the cost of return shipping for customer-initiated returns. If a customer wishes to return an item, they are fully responsible for all associated shipping expenses. Additionally, Nocturnal Optics does not provide pre-paid or complimentary return shipping labels.

How To Initiate A Warranty Claim

To initiate a warranty claim with Nocturnal Optics, customers are encouraged to follow the specified steps.

Firstly, they can reach out to Nocturnal Optics by visiting the Contact Page on their website or by sending an email to admin@nocturnalopticsau.com. In the email, customers should provide the following details:

1. Order Number

  • Customers should include their order number, which can be found in their order confirmation or invoice.

2. Item Description

  • It is important to provide a clear and accurate description of the item for which they are initiating the warranty claim. This helps Nocturnal Optics identify the product in question.

3. Detailed Description of the Issue/Fault

  • Customers should provide a thorough description of the issue or fault they are experiencing with the product. They should also explain the circumstances leading to the fault occurring, if applicable. The more information provided, the better Nocturnal Optics can understand and assess the situation.

4. Relevant Videos and Images

  • If possible, customers should include any videos or images that clearly illustrate the issue they are facing. This visual evidence can greatly assist Nocturnal Optics in evaluating the problem.

  • Upon receiving the Warranty Claim Request Email, the team at Nocturnal Optics will strive to respond within 24 hours. They will provide various solutions to address the customer's concern effectively.

  • It is important to note that customers should contact Nocturnal Optics prior to shipping the item. Failure to do so may result in the item being returned to the sender.

Upon Acceptance Of A Warranty Claim

  • Customers must properly pack, insure, prepay the shipping charges and ship the defective equipment or part to our Warranty Center or to any Authorized Warranty Repair Center indicated by us.

  • Nocturnal Optics will repair or replace the defective equipment or part and pay for its return to you, provided the repair or replacement is covered by our warranty.

  • Warranty claims falling outside of the scope of these warranty terms may incur repair, labor and shipping fees charged to the Customer. Customers are responsible for understanding and adhering to the warranty terms to avoid incurring additional repair, labor, and shipping fees.
Damages Not Covered By Warranty

The following damages, defects, or conditions are not covered under the Nocturnal Optics warranty:

  • Any defects or damage resulting from abuse, misuse, or improper handling by the buyer or user.

  • Units that have been operated in any manner inconsistent with their intended, normal, and customary use.

  • Units that have been misused, neglected, or damaged due to accidents or improper storage.

  • Defects or failures arising from unauthorized repairs, modifications, disassembly, or alterations by anyone other than Nocturnal Optics. This includes any units that have been tampered with or modified in any way.

  • Damage caused by faulty, leaking, or improperly maintained batteries, including corrosion of the battery compartment.

  • Defects, damage, or failures resulting from normal wear and tear, or purely cosmetic imperfections that do not affect functionality.

  • Performance issues when the equipment is used in conjunction with devices that are mechanically or electronically incompatible.

  • Any consequential damages suffered by the buyer or user for any reason, including but not limited to improper storage, improper operation, or repair or servicing by non-authorized parties.

  • Products that have been discontinued by the manufacturer, where replacement parts or units are no longer available due to circumstances beyond the control of Nocturnal Optics Australia.
5-Year Manufacturer’s Warranty — Complete Night Vision Systems Built By Nocturnal Optics Australia

All Nocturnal Optics Australia complete-built night vision systems — including monocular, binocular, and panoramic devices — are covered by a 5-year manufacturer’s warranty from the date of purchase.

If your Nocturnal Optics system fails during normal use due to a defect in materials or workmanship within this five-year period, Nocturnal Optics, at its sole discretion, will either repair the defective equipment or part, or replace it with new, reconditioned, or remanufactured equipment or parts, at no cost to you (excluding customer shipping fees).

  • This warranty is transferrable but the warranty duration is valid from the date the device was originally sold to the original purchaser. Each system is individually serial numbered and each component is tracked.  The warranty for each system is traceable through its unique serial number, ensuring accountability.

In addition to repair or replacement coverage, this warranty also includes complimentary access to our professional Collimation and Dry Nitrogen Purge services as part of regular maintenance during the warranty period. These services help ensure that your equipment remains properly optically aligned, sealed, and performing at its best throughout its service life.

This warranty remedy constitutes the full extent of Nocturnal Optics’ liability and the customer’s sole and exclusive remedy. No other warranties, representations, or guarantees — express or implied — are made by Nocturnal Optics, and all such warranties are expressly disclaimed.

Warranty Policy - North Night Vision Technologies (NNVT) Image Intensifier Tubes

1-Year Manufacturer’s Warranty

  • North Night Vision Technology Generation 2+ Intensifier Tubes include a standard 1-year manufacturer’s warranty, covering defects or damage resulting from the manufacturing process.

Exclusions

This warranty does not cover damage caused by end-user negligence, accidents, intentional misuse, or improper handling. Only defects in the manufacturing process are eligible for warranty claims.

  • Spots or blemishes on NNVT intensifier tubes are not considered defects and will not be accepted as a warranty claim.
  • The warranty does not cover tube blemishes, theft, loss, intentional damage, or damage caused by incorrect usage of the night vision system.
Warranty Policy — Infiray Outdoor Thermal Imaging Systems

InfiRay Warranty and Repair Policy

InfiRay is committed to the quality and reliability of its products. Under conditions of normal use and proper maintenance, if a product exhibits performance failure due to material defects, manufacturing issues, or workmanship errors during the warranty period, we will provide warranty service in accordance with the terms below.

Warranty Coverage

Warranty Commencement Date

  • For products purchased through an authorized InfiRay distributor or dealer, the warranty period begins from the date of purchase listed on the original invoice.

  • If a valid purchase invoice is not available, the warranty period will default to the date of shipment from the InfiRay manufacturing facility.

Standard Warranty Periods

Standard Warranty Coverage

  • The main device body is covered by a 3-year warranty.
  • Rechargeable or replaceable batteries are covered for 2 years.
  • The infrared detector (sensor component) is covered for up to 10 years.

Please note: These are standard warranty terms. Specific agreements or exceptions may apply based on the terms of the purchase and sales contract.

Exclusions from Warranty Coverage

The warranty does not apply under the following circumstances:

  • Devices with damaged or illegible nameplates or serial number barcodes.
  • Any modifications, disassembly, or repairs conducted without prior authorization from InfiRay.
  • Failures or damage resulting from misuse, neglect, or failure to follow the product’s operating, maintenance, or storage instructions.

This warranty constitutes the full extent of Nocturnal Optics’ liability, and the customer’s sole and exclusive remedy. No other warranties, representations, or guarantees — express or implied — are provided, and all such warranties are expressly disclaimed.

Lifetime Warranty — Nocturnal Optics OEM Housings

All housings manufactured by Nocturnal Optics Australia — including the UMNVD‑B, UMNVD‑F, UMNVD‑M, and UMNVD‑P — come standard with a Lifetime Warranty. Please review the details of this warranty carefully.

What This Warranty Covers

If any component of your housing, originally manufactured and supplied by Nocturnal Optics, requires replacement at any time during the product’s lifespan, we will provide a replacement component free of charge (shipping costs remain the responsibility of the customer).

We take pride in the durability of our products and prioritize customer confidence. This warranty even covers accidental damage resulting from drops or heavy impacts that cause breakage of the housing.

This warranty also applies to second-hand purchases. If you acquired a Nocturnal Optics housing from a third party, the product remains fully covered under this warranty, and no proof of purchase is required to submit a claim.

What This Warranty Does Not Cover

It is important to note that this warranty applies only to the housing and components manufactured by Nocturnal Optics. Specifically:

  • Lenses and image intensifier tubes are not covered.

  •  Any damages or defects related to lenses or intensifier tubes must be addressed separately. Please contact us directly for guidance on these components.

  •  Items or components not manufactured by Nocturnal Optics are excluded from this warranty.

If you have purchased items from another retailer or components not OEM by Nocturnal Optics, we recommend contacting the original manufacturer for their specific warranty terms and assistance.

This Lifetime Warranty reflects our commitment to quality and customer satisfaction, ensuring you can rely on your Nocturnal Optics housing for years to come — regardless of how it was acquired.

Surplus Item Warranty Disclaimer

Due to the nature of surplus items, some products may exhibit wear and tear consistent with prior use, as described on their respective product pages. Such wear and tear is not covered under any warranty, and claims relating to these pre‑disclosed conditions will not be accepted.

Surplus items are sold as‑is, and customers should review the item descriptions and grading carefully before purchase.

Surplus Item Grading System

To assist customers in understanding the condition of surplus merchandise, Nocturnal Optics applies the following grading criteria:

  • Grade 1: Brand New — Item is unused and may include original tags and/or packaging. All zips, Velcro, and fastenings are fully functional.

  • Grade 2: Moderately Worn — Item shows visible signs of use such as fading and minimal to moderate general wear and tear. Zips and Velcro remain functional.

  • Grade 3: Heavily Worn — Item shows significant signs of wear, including extreme fading, fraying, small holes, and potential damage to zips or Velcro.

Surplus Merchandise Disclaimer

Please note that surplus items may bear identification markings, labels, or other evidence of previous ownership or use, regardless of their assigned grade.

Items may also differ slightly from the representative photos provided, which are intended for illustrative purposes only.

By purchasing surplus merchandise, customers acknowledge and accept these conditions.

International Customers Returning Products To Nocturnal Optics Australia For Warranty Purposes

If you are an international customer returning products to Nocturnal Optics Australia for warranty inspection, repair, or replacement, please note:

  • It is the responsibility of the customer to comply with the export control laws and regulations of their own country. This includes applying for and obtaining any necessary export permits, licenses, or documentation required to legally export the product from your country back to Australia.

  • Nocturnal Optics Australia cannot assist with, or be held responsible for, the export application process or any delays caused by missing or incorrect paperwork.

  • We strongly recommend that you contact the relevant government export authority in your country before shipping the product to ensure you meet all legal requirements.

Returns Policy

Our returns policy operates in addition to your rights under the Australian Consumer Law (ACL), as we strive to ensure your satisfaction with every purchase.

Under the ACL, you are entitled to a repair, replacement, or refund if a product you purchase:

  • Is faulty or of unacceptable quality
  • Does not match the description provided
  • Is not fit for its intended purpose
  • Does not meet other consumer guarantees under the ACL

These rights apply even if the product is covered by a separate manufacturer’s warranty.

Important Notice: Refunds, Customs, and International Orders

You will not be entitled to a refund for the cost of the item or any postage and handling fees if your order is not delivered to you due to any of the following reasons:

  • The order is not collected by you.

  • The order is rejected or denied entry at the border.

  • The order is returned to sender.

  • Applicable fees, duties, or taxes are not paid by you.

Important: Certain items may be restricted or prohibited in your country and may be withheld or confiscated by border authorities. Nocturnal Optics is unable to monitor or guarantee compliance with the import requirements of every country.

  • It is your responsibility to ensure that the items you order comply with your local customs laws and regulations and are eligible for importation into your destination country.

  • Additionally, please note that warranties may not apply to goods purchased for use outside of Australia, except where required by Australian law.

We strongly recommend that you verify your country’s import requirements and restrictions before placing an order to avoid any potential issues at customs.

Change of Mind Returns Policy

If you have changed your mind about your purchase, we are happy to offer you an exchange or refund, provided that the following conditions are met:

  • The items are returned (repackaged and sent) within 7 days of delivery.

  • You can provide proof of purchase at the time of return, such as the original receipt, online tax invoice, or other adequate documentation.

  • The items have not been used, damaged, or altered in any way, and:

  • They remain in their original packaging, including all manuals, pamphlets, and
    accessories.

  • They are unopened, unused, and in their original, saleable condition.

If an item has not yet shipped from the Nocturnal Optics store, customer refund requests made within 24 hours of purchase are eligible for a full (100%) refund.

For refund requests received after 24 hours but before shipment, approximately 95% of the original payment can be refunded, as merchant fees and credit card processing costs incurred at the time of purchase cannot be recovered.

Where an item is eligible for a refund, the refunded amount will be returned to your original payment method.

Please note that shipping costs for both the original order and the return are non-refundable and remain the responsibility of the customer.

Important:

  • Online orders must be returned by mail only.
  • Return delivery address details will be provided during the returns process.
  • Any returned items that do not comply with this Change of Mind Returns Policy cannot be refunded and will be returned to the customer at their expense.

Other Returns

We will accept returns and offer you a refund, exchange, or repair where the product:

  •  Is faulty or not of acceptable quality.

  •  Is significantly different from what was shown or described to you.

  • Is not fit for its intended purpose.

  •  Is unsafe.

Where an item is eligible for a return under these circumstances, we will refund the full price of the item, along with any associated shipping costs, to your original payment method.
