Shipping
Defence Export Permits
Mandatory Defence Export Permits For International Orders
When purchasing items that are export controlled, it is important to note that these products require a Defence export permit.
This permit is necessary due to the nature of the items and their associated restrictions.
The process of obtaining the permit usually takes around 10-12 days for processing and approval.
Once the permit has been successfully accepted and issued by the Defence Export Controls Office, the devices or parts can then be shipped to the customer. The shipping method typically used is Australia Post.
It is important for customers to acknowledge and understand that when they purchase a regulated item, it cannot be shipped until the export permit is granted.
This is a legal requirement that ensures compliance with export control regulations
Defence Export Permit Restocking Fee
In the event that a customer requests a refund during the time it takes to obtain the export permit, a restocking fee may be charged, unless special circumstances apply.
This is to cover any costs associated with the handling and processing of the order.

All of our items are shipped via Tracked Australia Post Express. Our shipping method guarantees fast and reliable delivery through Tracked Australia Post Express.
Shipping Insurance and Extra Cover
Extra Cover and Insurance Overview
Extra Cover (Insurance) provides loss or damage cover up to the specified value of your item (up to $5,000AUD) while it’s being carried by Australia Post. This additional protection ensures that your item is safeguarded against unforeseen circumstances during transit.
Insurance, by default, is at $100 AUD. Extra Insurance cover is $2.50AUD for each subsequent $100 of cover (above $100 included cover) up to $5000.
Shipping Security Disclaimer
Security Overview
Due to the sensitive and expensive nature of our Thermal and Night Vision Systems, we take extra precautions when it comes to shipping our products.
Signature On Delivery Without Exception
This ensures that we can confirm that the customer has received the item in person and adds an extra layer of security to the shipping process. Verifying the customer's receipt in person enhances the reliability of the shipping process.
In addition to the required signature, we also fit our packages with tamper-evident security seals. These seals are designed to show if there has been any unauthorized access to the package during transit. This is an additional measure we take to protect the integrity of our products.
If, however, a customer suspects unauthorized tampering with their package during transit (excluding Government/Customs screening), we request that they promptly report the incident.
They should contact the shipping carrier and provide them with full details of the incident. It is also important to inform our Nocturnal Optics Team by sending an email to admin@nocturnalopticsau.com.
We take such incidents seriously and will conduct a thorough investigation to address the matter.

We are unable to remain across every countries Defence Goods and Technologies import requirements, Nocturnal Optics will always strive to review foreign export requirements to the best of its ability in order to remain compliant, however, it is the customers main responsibility to ensure that what you order will be able to clear customs.
Customers are advised to conduct research on their country's import regulations to ensure a smooth customs clearance process.
Please check with your local customs office to verify if the items you are ordering comply with import regulations.

Any applicable taxes and duties are the sole responsibility of the importing party and must be fully paid by them.
Customers should be aware that import taxes and customs duties are not included in the purchase price. It is the responsibility of the importing party to cover these additional fees.
We kindly request that customers familiarize themselves with their local tax regulations and requirements prior to making a purchase.
Lead Times and Pre-Orders
Lead Times
Pre-orders or items with a lead time have their wait times clearly stated on the product pages. Customers are encouraged to review product wait times before placing an order.
Special Order Items as indicated on some of our product pages incur a standard Lead time and are shipped 4-6 weeks after purchasing.
Order Cancellations Or Order Shipping Address Changes
Cancellation Notice Period
Nocturnal Optics has a strict policy regarding cancellations and changes of shipping address. If a customer needs to cancel an order or report a change of shipping address, they must notify Nocturnal Optics within 48 hours of the package being shipped.
It is essential to adhere to this time frame as any notification received outside of the 48-hour window will make it difficult for Nocturnal Optics to retrieve or redirect the package after it has been sent to its original address.
Return Shipping Expenses
Additionally, it is important to note that Nocturnal Optics does not cover the expenses for customer return shipping. Therefore, if a customer wishes to return an item, they will be responsible for the shipping costs.
Furthermore, Nocturnal Optics will not supply customers with return shipping labels.
Countries We Ship To
Only Those Listed On The Defence Trade Control Act (DTCA) 2012 - Foreign Countries List
As part of our obligations to Australian Defence Export Controls and relevant treaties, Nocturnal Optics only ships Export Controlled technologies (Night Vision Tubes, Thermal Imaging Equipment, Laser Illuminators, etc.) to countries specified on the Defence Trade Control Act (DTCA) 2012 - Foreign Countries List (FCL).
These countries include:
Austria, Belgium, Bulgaria, Canada, Czech Republic, Denmark, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Japan, Luxembourg, Netherlands, New Zealand, Norway, Poland, Portugal, Spain, Sweden, Switzerland, United Kingdom and the United States.
Warranty
What Is Not Covered By Warranty
- Defects or damage caused by buyer or user abuse or misuse.
- Units that have been used in any other way other than its normal and customary manner.
- Units that have been misused, neglected, or damaged by accident.
- Defects or failures caused by unauthorized attempts to repair or alter the equipment in any way by persons other than Nocturnal Optics (Includes units that have been altered, modified or disassembled).
- Damage caused by rechargeable batteries, leaking batteries or battery compartment corrosion due to faulty battery.
- Damage, defects, or failures attributed to normal wear and tear or cosmetic defects.
- The performance of the equipment when used in combination with equipment which is electronically or mechanically incompatible.
- Consequential damages incurred by a buyer or user from any cause whatsoever, including, but not limited to improper storage, operation and non-Nocturnal Optics repair or service costs.
- Products that were discontinued by the manufacturer and either parts or replacement units are not available due to reasons beyond the control of Nocturnal Optics Australia.
Initiating A Warranty Claim With Nocturnal Optics
How To Initiate A Warranty Claim
To initiate a warranty claim with Nocturnal Optics, customers are encouraged to follow the specified steps.
Firstly, they can reach out to Nocturnal Optics by visiting the Contact Page on their website or by sending an email to admin@nocturnalopticsau.com. In the email, customers should provide the following details:
1. Order Number
Customers should include their order number, which can be found in their order confirmation or invoice.
2. Item Description
It is important to provide a clear and accurate description of the item for which they are initiating the warranty claim. This helps Nocturnal Optics identify the product in question.
3. Detailed Description of the Issue/Fault
Customers should provide a thorough description of the issue or fault they are experiencing with the product. They should also explain the circumstances leading to the fault occurring, if applicable.
The more information provided, the better Nocturnal Optics can understand and assess the situation.
4. Relevant Videos and Images
If possible, customers should include any videos or images that clearly illustrate the issue they are facing. This visual evidence can greatly assist Nocturnal Optics in evaluating the problem.
Upon receiving the Warranty Claim Request Email, the team at Nocturnal Optics will strive to respond within 24 hours.
They will provide various solutions to address the customer's concern effectively.
It is important to note that customers should contact Nocturnal Optics prior to shipping the item. Failure to do so may result in the item being returned to the sender.
Upon Acceptance Of A Warranty Claim
Customers must properly pack, insure, prepay the shipping charges and ship the defective equipment or part to our Warranty Center or to any Authorized Warranty Repair Center indicated by us.
Nocturnal Optics will repair or replace the defective equipment or part and pay for its return to you, provided the repair or replacement is covered by our warranty.
Warranty claims falling outside of the scope of these warranty terms may incur repair, labor and shipping fees charged to the Customer. Customers are responsible for understanding and adhering to the warranty terms to avoid incurring additional repair, labor, and shipping fees.
Warranty Disclaimer - AB Night Vision
10 Year Manufacturers Warranty
In the event that your AB Night Vision System fails in normal use because of a defect in workmanship or materials within ten years from the date of shipment, Nocturnal Optics, at its sole discretion, will either repair or replace the equipment or part with new, reconditioned, or remanufactured equipment or parts without charge to you.
Such action on the part of Nocturnal Optics shall be the full extent of the Businesses liability and Customer’s sole and exclusive remedy. No other warranties, representations, or guarantees are made by Nocturnal Optics, and all other warranties are hereby disclaimed.
What Is Not Covered
It is important to note that this warranty does not cover Intensifier Tube Blemishes, theft, loss, intentional damage, or user error/ improper usage resulting in damage to the Night Vision System.
Warranty Disclaimer - ACTinBlack Europe Night Vision Devices
12 Month Manufacturing Warranty
ACTinBlack Night Vision Units come with a 12 month warranty covering manufacturing defects during normal use.
In the event that your ACTinBlack System fails in normal use because of a defect in workmanship or materials within 12 Months from the date of shipment, Nocturnal Optics, at its sole discretion, will either repair or replace the equipment or part with new, reconditioned, or remanufactured equipment or parts without charge to you.
Please be aware that misuse, negligence, or unauthorized repairs void the warranty.
Such action on the part of Nocturnal Optics shall be the full extent of the Businesses liability and Customer’s sole and exclusive remedy. No other warranties, representations, or guarantees are made by Nocturnal Optics, and all other warranties are hereby disclaimed.
Additional Repair Services
ACTinBlack is able to facilitate paid repairs services in the event that a housing is damaged outside of the scope of this Warranty. Our goal is to ensure that your product remains in top condition, even in the case of unforeseen damage to the housing.

It is important to note that this warranty does not cover Intensifier Tube Blemishes, theft, loss, intentional damage, or user error/ improper usage resulting in damage to the Night Vision System.
Warranty Disclaimer - Argus Night Vision Devices
3-Year Factory Warranty:
For each full night vision build (Ready to Ship Unit) purchased from Nocturnal Optics, there is a 3-year Factory Warranty that is valid from the date of purchase.
6-Month Image Intensifier Tube Warranty:
In regards to Argus's Image Intensifier Tubes, they come with a 6-month warranty specifically for factory faults or defects (excluding blemishes or spots).
Warranty Voidance:
Additionally, if a customer modifies or disassembles the complete unit provided by Nocturnal Optics or another vendor, the warranty claims will not be granted, and the remaining warranty on the device will be voided.
What Is Not Covered
It is important to note that this warranty does not cover Intensifier Tube Blemishes, theft, loss, intentional damage, or user error/ improper usage resulting in damage to the Night Vision System.
Warranty Disclaimer - InfiRay Thermal Imaging Devices
Internal Components 1-Year Manufacturers Warranty:
InfiRay Thermal Imaging Products are equipped with a one-year warranty on internal components for system faults/factory repairs.
External Components 2-Year Manufacturers Warranty:
Moreover, there is a two-year warranty on external components for repairs.

Warranty Disclaimer - Night Vision Optical Lens Assemblies
Lens Assemblies Warranty Disclaimer:
Nocturnal Optics does not provide any warranty for our lens assemblies/systems (ANVIS-9, YMON, Carson and Other PVS-14 style lenses).
It is important for customers to thoroughly review the product description to fully understand the specifications and limitations of our lens assemblies/systems.
For the installation of Night Vision Lens, we strongly recommend seeking professional assistance from a night vision technician.
Improper assembly may result in damage to the lens and other components of your Night Vision system.
Nocturnal Optics will not be held responsible for any such damages.
Warranty Disclaimer - Nocturn Industries
Lifetime Warranty On Housing Components
Nocturn Industries features a lifetime warranty policy on housing products or components that they manufacture. This warranty ensures that customers can trust in the quality and durability of Nocturn Industries products.
Fully Built Night Vision Systems Disclaimer
For fully built night vision systems this Lifetime Warranty applies only to the housing of the system. Any issues with the system's functionality outside of the housing are not covered under the Lifetime Warranty.

Warranty Disclaimer - Nocturnal Optics Australia
Housing Lifetime Warranty:
All items manufactured by Nocturnal Optics come standard with a Lifetime Warranty. Please read through this warranty carefully.
This means that if any component of your housing, which is originally manufactured and supplied by Nocturnal Optics, needs replacement at any point during the lifespan of the product, we will provide a new component free of charge (excluding shipping fees on behalf of the customer).
We prioritize customer satisfaction and want you to feel confident in purchasing our products. Therefore, we ensure that you are covered even if you accidentally drop your night vision device or it experiences a heavy impact resulting in housing breakage.
Damage Covered Under This Warranty:
Our warranty covers such incidents and guarantees replacement for any housing component. It is important to note that this warranty also applies to second-hand purchases. Even if you bought a housing from someone else, as long as it is originally manufactured and supplied by Nocturnal Optics, it is still covered under our warranty.
No purchase order is needed for warranty claims on second-hand products.
Not Included Under This Warranty:
IMPORTANT: This warranty specifically excludes damages to lenses or intensifier tubes. For any issues or damages related to these parts, you will need to contact us separately for further assistance.
Furthermore, please be aware that items not manufactured by Nocturnal Optics are not covered under this warranty.
If you have purchased other items from a different retailer that are not OEM by Nocturnal Optics, we recommend contacting the original manufacturer for their specific warranty information.
Warranty Disclaimer - North Night Vision Technology (NNVT) Intensifier Tubes
1 Year Manufacturers Warranty:
North Night Vision Technology Generation 2+ Intensifier Tubes are equipped with a standard 1-year warranty provided by the manufacturer, covering any damages or defects caused during the manufacturing process.
Not Covered By Warranty:
Manufacturers Warranty does not cover End-User negligent/accidental or intentional damage to Intensifier Tubes, only system defects are covered under this Warranty.
Spots or blemishes on NNVT intensifier tubes are NOT a valid warranty claim and will be refused.
What Is Not Covered
It is important to note that this warranty does not cover Intensifier Tube Blemishes, theft, loss, intentional damage, or user error/ improper usage resulting in damage to the Night Vision System.
Safe Operation Of Fully Built Night Vision Products
Safe Handling Procedures For Image Intensification Night Vision Systems
The customer is hereby notified that operation of Night Vision equipment during daylight or under excessive light conditions may permanently damage the internal components of the unit.
To ensure the longevity of the Night Vision equipment, it is important to refrain from using it in bright light conditions as it may cause permanent damage to its internal components.
Any damage of this nature is not covered under Warranty and any associated claims will be refused. Please ensure that you handle the product with care to avoid any damage not covered under warranty.
Returns
Australian Orders - Return Policy Disclaimer
Our returns policy is in addition to your rights under the Australian Consumer Law, as we want you to be satisfied with your purchase. Please review our detailed return policy for more information on how to initiate a return.
International Orders - Return Policy Disclaimer
You will not be entitled to a refund for the cost of the item or postage and handling if you do not receive your order due to one of the following:
- Your order is not collected, or
- Your order is rejected at the border, or
- Your order is returned to sender, or
- Fees or duties are not paid by you
IMPORTANT: Certain items may be restricted in your country and may be withheld at the border. We are unable to remain across every countries import requirements and it is your responsibility to ensure that what you order will be able to clear customs.
Warranties may not apply for certain goods purchased for use outside of Australia, except where required by Australian law.
Change of Mind Returns & Refunds
If you have changed your mind about your order, we are happy to offer you an exchange or refund provided that:
- The items are returned within 7 days of delivery.
- You can show your original receipt, online tax invoice or other adequate proof of purchase at the time you return the items;
- The items have not been used or damaged in any way including that:
- They are in their original packaging including manuals, pamphlets and all accessories; and/or
- They are unopened, unused and in their original saleable condition;
If an item hasn't shipped from the Nocturnal Optics Store yet, customer refund requests within 24 hours receive 100% cost return. Outside of 24 hours, approximately 95% of the original payment can only be returned due to credit card provider costs and fees absorbed at payment capture.
Where an item is eligible for a refund, we will refund the price of the item to your original payment method. Shipping costs for the order and return will not be refunded.
Online orders must be returned by mail only. Return delivery address details will be shared as your return is processed.
Any items returned that don’t comply with our change of mind returns policy are unable to be refunded.
Other Returns
We will accept returns and provide you with a refund, exchange or repair where the product is:
- Is faulty or is not of acceptable quality, or
- Significantly different to those shown or described to you, or
- Not fit for its intended purpose, or
- Unsafe.
Where an item is eligible for a refund of this kind, we will refund the price of the item as well as any associated shipping costs to your original payment method.

Nocturnal Optics Australia is dedicated to maintaining a safe and respectful environment for all employees, partners, customers, and stakeholders.
Nocturnal Optics Australia adheres to a zero-tolerance policy that strictly prohibits harassment, discrimination, threats, coercion, fraudulent activity and related behaviors.
Nocturnal Optics Australia will not consider requests or queries that violate this policy under any circumstance.
Breaches of our Unacceptable Behavior Policy may be reported to the relevant State/ Federal Law Enforcement departments for further investigation.
