Nocturnal Optics - Australian Defence Export Control Liability Notice
Australian Defence Export Control Notice:
Dual-Use Goods & Technologies listed on the Defence Strategic Goods List (DSGL) necessitate a Defence Export Permit for shipping outside Australia. Image Intensification and Thermal Imaging Equipment are covered by the DSGL.
Violating Australian Defence Export Controls Legislation and ABF Exports Regulations may lead to prosecution, fines, and/or imprisonment.
The customer/end-user, upon purchase, acknowledges and agrees that Nocturnal Optics Australia and its branches bear no legal responsibility for customer/end-user non-compliance with Defence Export Controls concerning unauthorized re-export of DSGL Regulated Items.
EAR99 - US Export Administration Regulations Notice
EAR99 - Export Administration Regulations Notice:
Some products on the Nocturnal Optics Website are classified as EAR99 under USA Export Administration Regulations.
EAR99 products cannot be exported to embargo-countries (Iran, North-Korea, Syria, etc.).
After purchase, Nocturnal Optics Australia is obligated (as per existing US-AUS Treaties) to verify compliance with EAR99 regulations by cross-checking customer information against the USA Consolidated Screening List.

Changes to Defence Export Control Laws - 1st Of September, 2024
On 1 September 2024, the new Defence Trade Controls Amendment Act 2024 and Defence Trade Legislation Amendment Regulations 2024 commenced. This updated Australia’s defence export controls laws in 2 major ways:
AUKUS License-Free Environment
Establishment of a licence-free environment, where permit requirements are waived for most military and dual-use goods and technology items exported, re-exported or transferred between Australia, United Kingdom and United States (AUKUS) partners.
Nocturnal Optics Australia can now export Night Vision and Thermal Imaging Products to AUKUS Partners in a license-free environment, eliminating the need for an Australian Defence Export Permit.
DTCA 2012 Legislation Controls
Creation of 3 new controls in the Defence Trade Controls Act 2012 (in addition to the existing controls):
- Section 10A: supply of Defence and Strategic Goods List (DSGL) technology to a non‑exempt foreign person within Australia.
- Section 10B: supply of goods and technology on Part 1 (Munitions) and Part 2 (Dual Use) ‘Sensitive’ and ‘Very Sensitive’ Lists of the DSGL, that was previously exported or supplied from Australia
